EXECUTIVE ORDER: 

 

The ban on entrants from countries Iran, Iraq, Somalia, Sudan, Syria, Libya and Yemen begins on January 27, 2017 for a period of 90 days. The ban includes ALL individuals FROM those countries. This means people:


1. Born in those countries
2. People with nationality in those countries
3. People who hold dual nationality with those countries and another country
4. Legal Permanent Residents ("Greencard" holders) in the U.S. in one of the above 3 categories.

The ban does not include individuals who are U.S. Citizens who are born in those countries or people who have simply traveled to those countries. 

NONIMMIGRANTS (STUDENTS/WORK VISA HOLDERS), ASYLEES, REFUGEES, AND IMMIGRANT VISA HOLDERS OUTSIDE THE U.S. WHO ARE BORN IN OR CITIZENS OF IRAN, IRAQ, SOMALIA, SYRIA, SUDAN, LIBYA AND YEMEN:

Based on the Executive Order of President Trump signed January 27, 2017 entitled “Protecting the Nation from Terrorist Attacks by Foreign Nationals”, we are advising those of you on student visas, work visas, refugee or asylum status who are born in or have citizenship in Iran, Iraq, Somalia, Sudan, Syria, Libya or Yemen not to leave the United States as you will not be allowed to reenter. 

If you are currently outside of the U.S. and hold a U.S. nonimmigrant or immigrant visa you should for now cancel your travel plans until further information is available on what will happen if you attempt entry. At this time it appears that you will be detained at the airport and/or sent back to the country you came from. 

LEGAL PERMANENT RESIDENTS ("GREENCARD" HOLDERS) BORN IN OR CITIZENS OF IRAN, IRAQ, SOMALIA, SUDAN, SYRIA, LIBYA, AND YEMEN:

The executive order whether APPLIES to people who are legal permanent residents("greencard" holders) of that United States. We are advising legal permanent residents ("greencard" holders) of the U.S. who were born in or are citizens of Iran, Iraq, Somalia, Sudan, Libya or Yemen to not leave the U.S. as you may not be allowed to reenter. In our opinion this should not apply to legal permanent residents and we are sure that this is be litigated in the future unless government guidance is issued. There appear to be some limited ability for the Department of Homeland Security, U.S. CBP (Border Patrol) to admit legal permanent residents on a case-by-case basis, following a through security review. However, we do not know at this time how this policy will be applied.

If you are not from one of these countries but have friends from one of these 7 countries please let them know of the travel ban and not to leave the U.S. or try to enter until further information and procedures have been established.

UPDATE: Federal Court Temporarily Stops Executive Order: http://thehill.com/blogs/blog-briefing-room/news/316714-federal-judge-blocks-trump-immigration-ban-nationwide THE EXECUTIVE ORDER HAS BEEN STOPPED. IT HAS NOT BEEN OVERTURNED. OUR ADVICE IS THAT IF THIS ORDER APPLIES TO YOU, DO NOT TRAVEL UNTIL THERE IS A FINAL COURT DECISION AND A FINAL GOVERNMENT POLICY. 

IF YOU ARE OUTSIDE OF THE U.S. AND THIS ORDER APPLIES TO YOU PLEASE ENTER THE U.S. AS SOON AS POSSIBLE AND MAKE ARRANGEMENTS TO REMAIN UNTIL THERE IS A FINAL DECISION ON LAW AND POLICY.  PLEASE PRINT A COPY OF THE ATTACHED ORDER AND BRING IT WITH YOU.  PLEASE NOTE THIS ORDER PREVENTS REMOVALS BUT NOT DETENTIONS, SO PLEASE NOTIFY US BEFORE TRAVELING IN AS WE MAY NEED TO FILE A HABEAS PETITION FOR YOUR RELEASE IF YOU ARE DETAINED
 
There are lawsuits filed that challenge this Executive Order, the final regulations, laws are unknown at this point thus we further ADVISE: IF YOU ARE FROM ONE OF THE SEVEN LISTED COUNTRIES OR ARE A DUEL NATIONAL OF ONE OF THE SEVEN LISTED COUNTRIES PLEASE CONSULT US BEFORE TRAVELING OUT OF OR INTO THE UNITED STATES.
